Welcome to Elikiba AR. By accessing or using our website, mobile applications, and related services (collectively, "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Elikiba Signature ("Elikiba," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Services following any changes constitutes acceptance of the updated Terms.

- You are not prohibited from accessing the Services under any applicable law.
3. Account Registration and Security

- Upload, post, or transmit content that is unlawful, harmful, defamatory, or infringing.
- Impersonate any person or entity or misrepresent your affiliation.
- Interfere with or disrupt the Services or servers.
- Attempt to gain unauthorized access to any part of the Services.
- Use automated systems (bots, scrapers) to access the Services without permission.
- Engage in harassment, abuse, or threatening behavior toward other users.
- Upload malware, viruses, or other harmful code.
- Collect or harvest user data without consent.

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and AR experiences) are owned by Elikiba or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, display, perform, publish, license, create derivative works from, or sell any content from our Services without explicit written permission.
7. User Content
By submitting artworks or other content ("User Content") to our platform, you:
- Retain ownership of your original User Content.
- Grant Elikiba a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the Services.
- Represent that you own or have rights to submit the User Content.
- Acknowledge that User Content may be viewed by other users.
- Understand that we may remove User Content that violates these Terms.
8. Augmented Reality Features
When using our AR features, you acknowledge that:
- AR experiences require camera access and may collect visual data.
- You are responsible for your physical safety while using AR features.
- AR experiences should be used in safe, appropriate environments.
- We are not liable for any injuries or damages resulting from AR use.
- AR functionality may vary based on device capabilities.
9. Third-Party Services
Our Services may integrate with or link to third-party services, websites, or content. We do not control and are not responsible for third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability and fitness for a particular purpose.
- Warranties that the Services will be uninterrupted, error-free, or secure.
- Warranties regarding the accuracy, reliability, or completeness of content.
- Warranties that defects will be corrected or that the Services are virus-free.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIKIBA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, data, use, goodwill, or other intangible losses.
- Damages resulting from unauthorized access to or alteration of your data.
- Damages resulting from third-party conduct or content.
- Any amount exceeding the fees paid by you to Elikiba in the past twelve months.

You agree to indemnify, defend, and hold harmless Elikiba and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services.
- Your violation of these Terms.
- Your violation of any third-party rights.
- Your User Content.
- Any activity under your account.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:
- Your license to use the Services immediately terminates.
- You must cease all use of the Services.
- We may delete your account and associated data.
- Provisions that should survive termination (e.g., intellectual property, limitation of liability) will remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Nigeria.
15. Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at support@elikiba.com. We will attempt to resolve the dispute within 30 days. If we cannot resolve the dispute informally, you agree to binding arbitration or mediation under the rules of a recognized arbitration body in Nigeria.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Services, constitute the entire agreement between you and Elikiba regarding your use of the Services and supersede any prior agreements.
